I FOUND THE REGISTRATION PAPERS!!!!


Now, all I can do is write a statement, according to the sheriff. They're going to call this weekend and I'm supposed to call the investigator on Monday to see what's up. My main thing right now is that Max may be sold inbetween me getting the process done and them being served!!!

It's just frustrating. I've done the sheriff's job for them...I got all the phone numbers by tracking them down, got the addresses, papers, lease papers, vet bill for the wolf teeth removal...

Good for you getting all that information together. I have nothing good to say for our county sheriffs dept. local police, or county prosecutors office. I have experienced your frustration. I've never felt this way about law enforcement my whole life until I moved here. So I hope that investigator comes through for you. He should since you've got everything all layed out for him. You just need his authority to deal with this other jurisdiction. Lets hope nobody wanted to buy your horse from that theif. I hope the worth of this horse bumps this crime into a good felony charge. It seems to me the thief could be charged regardless of whether he still has possession of the horse. Since it was a lease he is required to still have it, right? If he doesn't have the horse then he has commited a crime. If this has happened he may talk about where the horse went in hopes the the police will go easy on him. So it's still possible you could get your horse back. If you don't get your horse back, the judge should order him to pay you for the horse and go to jail.

These are just some thoughts that occurred to me as I thought of your situation. You may have thought of this already. If so then we have a consesus. I just thought it might stimulate some questions when you talk to the investigator.

OK Mik,, now when all this is over, there are things called file folders,, I expect you to put all of Max`s records in one !!! LOL In the meantime,, what did the police investigator say about the situation ??

IDK, he wasn't in the office when I called at 9:30. I left a message so he should call me back. If he doesn't, I'm calling him back on my lunch break at work.

All of the papers are in ONE place now! In a folder in my "special" briefcase!

I talked to the investigator. They won't do a THING about it. They say that because there is a lease, it's a civil suit and needs to be dealt with through the court system. Needless to say...I'm getting an attorney after their asses. I am going to TRY to get Max put into protective custody so that nothing can happen to them.

When I talked to the investigator, he said he knew the guy that I leased it to and that I should have done a better job at reviewing him...next he said that the uncle will take care of the horse until something happens. Well that's all good and dandy but what if someone comes up and buys the horse?!

Mik, I would just go get my horse. He broke the lease agreement and the horse legally belongs to you. The lease agreement did not give him the right to sale the horse.
If you get there and the threatens to call the cops, let him, you are after your horse. Max does not belong to the guy, he belongs to you. Just do not go alone. Take a very large man with you. Drive up in a truck and trailer and load your horse. Do it where ever he is, at his house, at a roping, where ever, you have ever right to retrieve your horse as the agreement was broken.
Ask your lawyer but you should have every right to just go get him.

4j is right !! I would just go get him !! If the man objects tell him ,, Ok you will go ahead and file a report for theft then he will be in as much trouble as his nephew is for knowingly buying a stolen horse !!

I already filed the report for theft. The DA dismissed it as a civil suit. I'm looking for a new lawyer because the other one will not call me back at all.
